Agreement on accession to the project "ICSQ-775" / "IOSCEAAD-775"

on terms officially announced by the IASHE.

Hereby the IASHE (hereinafter referred to as the Organizer), represented by the head of the IASHE Expert Council Stivens Godving, company PLATONICK L.P, represented by the Chief Executive Arthur Morris (hereinafter referred to as the Executor) and the IASHE project (hereinafter referred to as the Project) participant or any other person interested in certain results of implementation of the IASHE project (hereinafter referred to as the Person Concerned) have concluded the following agreement:

1. The Person Concerned wishing to take part in the project, reasonably affect its results or make own related claims and demand for their official consideration in accordance with rules established by the IASHE, therefore joins the relevant project on terms officially announced by the IASHE.

2. Present agreement is the free contract of adhesion of the person concerned to IASHE projects in the relevant role.

3. Within the framework of all IASHE projects, any person officially addressing the IASHE concerning commitment of legally significant actions related to projects, automatically becomes the participant of relevant projects on terms of the present Agreement and other rules officially announced by the IASHE.

4. Executor carries out resource provision of all aspects of implementation of the IASHE projects.

5. In relation to subjects, whose objects have positively passed the certification according to the ICSQ-775 standard or patenting according to the IOSCEAAD-775 standard, their official international representative as well as the beneficiary (in relation to benefits brought by the indicated legal facts, in the volume coordinated with persons concerned) is the Executor - company PLATONICK L.P..

6. All disputes, disagreements, claims or demands emerging from the present Agreement and facts of participation of Persons Concerned in the IASHE projects in roles contemplated by the present Agreement or emerging in connection to it (and also connected with fulfillment, violation, termination or invalidity of the Agreement), are subject to final settlement in the American International Commercial Arbitration Court (LLC) in accordance with its Regulations.

7. Present Agreement is termless. It may be subject to cancellation through complete fulfillment of mutual obligations by parties, acceptance of such fulfillment by contractors or voluntary renunciation of fulfillment of it by parties.

Responsibility of the IASHE

1) The IASHE bears limited responsibility for determination of high qualitative parameters of the object in correspondence with the general rules of the ICSQ-775 standard on condition of absolute honesty of the certification initiator in matters of submission of information necessary for holding the certification expertise.

2) Any interested person may address the IASHE with the reasonable application (Note) concerning the discovered mismatch between the certified object and the determined quality standard. If such application is satisfied by the Professional Expert Council of the IASHE, it may become the basis for cancellation of certification of the relevant object.

3) Any interested person addressing the IASHE concerning initiation of the expertise or impugnment of its results, accepts the "Agreement on accession to the project "ICSQ-775" on terms officially announced by the IASHE" and therefore becomes the participant of the indicated project on terms formulated in this agreement.

Соглашение о присоединении к проекту «ICSQ-775» / «IOSCEAAD-775» на официально объявленных МАНВО условиях

Настоящим МАНВО, именуемый в последующем «Организатор», в лице Руководителя Экспертного совета МАНВО Стивенса Годвинга, компания PLATONICK L.P., в лице Исполнительного директора Артура Морриса, именуемый в дальнейшем «Исполнитель», и участник проекта МАНВО, либо иное лицо, заинтересованное в определенных результатах реализации проекта МАНВО (далее – «проект»), именуемое в дальнейшем «Заинтересованное лицо», заключили настоящее Соглашение о нижеследующем:

1. Заинтересованное лицо, имея намерение участвовать в проекте, обоснованно влиять на его результаты либо выдвигать свои претензии по их поводу и требовать их официального рассмотрения в соответствии с установленными МАНВО правилами, таким образом присоединяется к соответствующему проекту на официально объявленных МАНВО условиях.

2. Настоящее Соглашение является свободным договором присоединения заинтересованного лица к проектам МАНВО в соответствующем качестве.

3. В рамках всех проектов МАНВО, любое лицо официально обращающееся в МАНВО на предмет совершения юридически значимых действий, связанных с проектами, автоматически становится участником соответствующих проектов на условиях настоящего Соглашения и иных официально обнародованных правил МАНВО.

4. Исполнитель осуществляет ресурсное обеспечение всех аспектов реализации проектов МАНВО.

5. В отношении субъектов, объекты которых положительно прошли сертификацию по стандарту «ICSQ-775» или патентование по стандарту «IOSCEAAD-775», их официальным международным представителем, а также приобретателем выгоды, вытекающей из указанных юридических фактов в согласованном с заинтересованными лицами размере, является Исполнитель – компания PLATONICK L.P.

6. Все споры, разногласия, претензии или требования, вытекающие из настоящего соглашения и фактов участия заинтересованных лиц в проектах МАНВО в любом качестве, предусмотренном настоящим соглашением, либо возникающие в связи с ним, а также связанные с исполнением, нарушением, прекращением или недействительностью соглашения, подлежат окончательному разрешению в "Американском Международном Коммерческом Арбитражном Суде (LLC)" в соответствии с его Регламентом.

7. Настоящее соглашение является бессрочным и может подлежать прекращению полным исполнением его сторонами взаимных обязательств, а также принятием такого исполнения контрагентами либо добровольным отказом сторон от его исполнения.

 

Ответственность МАНВО

1) МАНВО несет ограниченную ответственность за установление высоких качественных параметров объекта в соответствии с общими правилами стандарта «ICSQ-775» при условии абсолютной добросовестности инициатора сертификации при предоставлении необходимой для проведения сертификационной экспертизы информации;

2) Любое заинтересованное лицо вправе обратиться в МАНВО с обоснованным заявлением («Нотой») о выявившемся несоответствии сертифицированного объекта необходимому уровню качества. Такое заявление, в случае его удовлетворения Профессиональной экспертной коллегией МАНВО, может являться основанием для отмены сертификации соответствующего объекта.

3) Любое заинтересованное лицо, обращающееся в МАНВО на предмет инициирования проведения сертификации или оспаривания его результатов, акцептует «Соглашение о присоединении к проекту «ICSQ-775» на официально объявленных МАНВО условиях» и, тем самым, становится участником указанного проекта на сформулированных в данном соглашении условиях.
